General

The following General Terms and Conditions (GTC) in their respective valid version apply exclusively to all business relationships of Igor Gostev acting under elektro-land.de (hereinafter referred to as "Seller").

Conclusion of Contract

For business relationships with the customer, the following General Terms and Conditions in their version valid at the time of the order apply to orders via the Elektroland24 online shop. § 10 and § 11 of the general terms and conditions of Elektroland24 apply to the conclusion of contracts in the Elektroland24 online shop. You can find a link to the Elektroland24 GTC at the end of every Elektroland24 page.

Prices

All prices stated are in EUR including the respective valid statutory value added tax (currently 19 percent) without discount and other rebates and without costs for packaging and shipping at the time of the order. The costs for packaging and shipping can be found in the respective item description.

Payment Terms

4.1   The payment methods displayed on the offer page are accepted. Installment payments are not permitted unless expressly agreed in writing. Unless otherwise agreed in writing, the amount is to be paid immediately in advance.

4.2   Invoices are to be paid within 10 days of the invoice date. After expiry of the payment period, the buyer is in default without further declaration by the seller, provided he has not made payment.

Retention of Title

The delivered goods remain the property of the provider until full payment has been made.

Delivery; Shipping Costs; Transfer of Risk

6.1   Delivery is made at the shipping costs stated in the respective item description. For orders by cash on delivery, separate cash on delivery fees are additionally charged. The amount of the fees is stated in the item description. Please note that in addition to the higher shipping costs, a cash on delivery fee of e.g. EUR 2.00 is also charged by DHL. This cash on delivery fee is charged on behalf of DHL and is not shown on the goods invoice.

6.2   If the customer is a consumer, the seller bears the shipping risk in any case, regardless of the type of shipping. If the customer is an entrepreneur, all risks and dangers of shipment pass to the customer as soon as the goods have been handed over by Igor Gostev to the commissioned logistics partner.

Cancellation Policy Right of Cancellation

A contract concluded between you and Igor Gostev via the Internet is a distance contract within the meaning of § 312b Paragraph 1 BGB. If you are a consumer within the meaning of § 13 BGB, you are therefore entitled by law to a right of cancellation under §§ 312d, 355 BGB (consumer cancellation for distance contracts). A consumer under § 13 BGB is any natural person who concludes a legal transaction for a purpose that cannot be attributed to either their commercial or their independent professional activity. The following instruction serves your information. 

The cancellation policy in text form, the model cancellation form, as well as the information required to fulfill the statutory information obligations will be sent to you immediately after conclusion of the contract.

Information about your right of cancellation 

Cancellation Policy 

You have the right to cancel this contract within 1 month without giving reasons. The cancellation period is 1 month from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. To exercise your right of cancellation, you must inform us (Igor Gostev Zwingel 4 55545 Bad Kreuznach, Tel: +49 163 5137234, E-mail: support@elektro-land.de) by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to cancel this contract. You can use the attached model cancellation form for this purpose, which is however not prescribed. To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period. Consequences of cancellation If you cancel this contract, we must repay to you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which the notification of your cancellation of this contract has been received by us.

For this repayment, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to (Igor Gostev Zwingel 4 55545 Bad Kreuznach immediately and in any case at the latest within 1 month from the day on which you inform us of the cancellation of this contract. 

The deadline is met if you send the goods before the expiry of the period of 1 month. You can use the model cancellation form deposited here (at: https://elektro-land.de/static/pdf/Elektroland24.pdf ), which is however not prescribed. You bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of them that is not necessary for checking the nature, properties and functioning of the goods. 

Exclusion or early expiry of the right of cancellation The right of cancellation does not exist for contracts 

• for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer; 

• for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded; 

• for the delivery of alcoholic beverages whose price was agreed upon conclusion of the contract, but which can be delivered at the earliest 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no influence; 

• for the delivery of newspapers, magazines or illustrated magazines with the exception of subscription contracts. 

The right of cancellation expires prematurely for contracts 

• for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery; 

• for the delivery of goods if these have been inseparably mixed with other goods after delivery due to their nature; 

• for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.

Consumer Information for Distance Contracts for the Purchase of Goods

Please refer to the individual product descriptions within our Internet offering for the essential characteristics of the goods offered by us as well as the validity period of limited offers. The language available for the conclusion of the contract is exclusively German. 

The contract text is stored as the Elektroland24 website after conclusion of the contract for up to 90 days and can be viewed by you at Elektroland24 by entering the respective item number. Using the print function of your browser, you have the option of printing out the contract text. You can also save the contract text by right-clicking to save the Internet page on your computer. The contract text is also stored by us. 

After conclusion of the contract, you will automatically receive an email with further information on the processing of the contract. Complaints and warranty claims can be submitted to the address stated in the provider identification. For information on payment, delivery or fulfillment, please refer to the offer.

Input errors can be identified before the final submission of an offer by checking the offer on a separate Internet page of Elektroland24 and, if necessary, corrected after pressing the "Back" button of your browser on the previous page.

Data Protection Notice

As the body responsible under the data protection provisions, we assure you that the collection, storage, modification, transmission, blocking, deletion and use of your personal data in our company for the protection of your personal data always takes place in accordance with the applicable data protection provisions and other statutory regulations.

Your personal data will only be passed on to third parties to the service partners involved in the processing of the contract, such as the logistics company commissioned with the delivery and the credit institution commissioned with payment matters. In cases where your personal data is passed on to third parties, however, the scope of the data transmitted is limited to the necessary minimum.

By concluding the contract, you consent to the collection, processing and use of your personal data in accordance with the above notices.

You have the right to receive information free of charge about the personal data stored about you. We may ask you to direct corresponding inquiries to the address stated in the provider identification. If the personal data stored about you with us is incorrect, the data will of course be corrected upon a corresponding notification from you. You also have the right to revoke your consent to the storage of personal data at any time with effect for the future. In the event of a corresponding notification, the personal data stored about you will be deleted, unless the data concerned is still required to fulfill the obligations of the concluded contractual relationship or statutory regulations prevent deletion. In this case, the deletion is replaced by blocking of the personal data concerned. For all data protection inquiries, we may ask you to contact the address stated in the provider identification.

Final Provisions

10.1   If the aforementioned provisions have not become part of the contract in whole or in part or are invalid, the contract shall otherwise remain effective. Insofar as the provisions have not become part of the contract or are invalid, the content of the contract shall be governed by the statutory provisions.

10.2   The law of the Federal Republic of Germany applies to the contractual relationship between the seller and the customer as well as to the respective terms and conditions. If the customer is a consumer, the statutory regulations and rights applicable under the law of the customer's country of residence in favor of the consumer remain unaffected by this agreement.

10.3   The exclusive place of jurisdiction is the local court of our registered office insofar as the customer is a merchant within the meaning of the HGB or a corporation under public law.

Notes according to the Battery Ordinance

In connection with the distribution of batteries or accumulators or with the delivery of devices that contain batteries or accumulators, the seller is obliged to inform the buyer in accordance with the Battery Ordinance of the following:

Batteries must not be disposed of in household waste. The buyer is legally obliged as an end consumer to return used batteries. After use, the buyer can return batteries free of charge at the point of sale or in its immediate vicinity (e.g. in municipal collection points or in retail). Furthermore, the buyer can also return batteries to the seller by post.

The seller will in any case reimburse the buyer for the postage for returning their old battery.

Batteries or accumulators containing pollutants are marked with the symbol of a crossed-out wheeled bin.
